Another HIPAA blogger recently posted an article titled “What’s a good set of Policies and Procedures worth?” In the article, the blogger recounted that he had drafted dozens of them and that, on average, he had charged around $5,000 to $10,000 for a worked-over set of policies adapted to the client’s specific needs. From visiting his blog periodically, I have no doubt that his services are competent, but he noted in this post that many clients balked at such a price tag.
He continued his blog item by asking the question as to what the set of policies would be worth. He said that the set of policies would have been worth $150,000 to Adult & Pediatric Dermatology in Massachusetts, which had lost a flash drive with unencrypted protected health information (“PHI”) on it and had agreed to pay that amount because it had not adopted policies that might have either prohibited the use of such devices or required encryption, according to the Department of Health and Human Services (“DHHS”) news release announcing this settlement.

The DHHS news release announcing this settlement also mentioned that the practice had failed to conduct adequate risk analysis and training.
